On March 1, 2024, in Johannesburg, South Africa, the recently established National Financial Ombud Scheme (NFO) officially launched its operations. The NFO serves as a consolidated, all-encompassing dispute resolution service, unifying the four former services: the Ombudsman for Banking Services (OBS), the Credit Ombud (CO), the Ombudsman for Long-Term Insurance (OLTI), and the Ombudsman for Short-Term Insurance (OSTI).
The Ombud Council formally recognized the NFO as an industry ombud scheme on February 23, 2024, in accordance with section 194 of the Financial Sector Regulation Act, 9 of 2017 (FSR Act). The NFO will start accepting complaints from March 1, 2024.
All the services and support that individuals and companies previously received from the separate Ombud schemes are now consolidated within the newly established NFO, and these services are offered to consumers at no cost. The amalgamation aims to capitalize on the success of its predecessors while creating a more streamlined, coordinated, and less confusing alternative dispute resolution framework for financial customers.
Reana Steyn, the Ombudsman for Banking Services, emphasizes the longstanding tradition of providing financial customers with redress for unfair treatment by financial institutions at no cost and with minimal formality. She believes that the unified entry point for complaints, with consistent rules for all types of issues, will benefit both customers and scheme participants.
Moreover, the NFO anticipates easier awareness creation and consumer education about the single scheme, as opposed to explaining the functions of four separate entities. Additional advantages include improved administrative efficiencies and the utilization of institutional knowledge, expertise, and staff experience accumulated over more than two decades, as each predecessor scheme will operate as a division of the NFO.
The Ombud Council’s recognition includes approval of the NFO’s governing rules, as required by Section 214 of the FSR Act. A comprehensive public consultation process on the proposed governing rules took place from November 2023, resulting in adjustments to the scheme’s documents based on received comments. The NFO acknowledges the contributions of various participants and stakeholders and expects an adjustment period as both the scheme and participants adapt to the new dispensation.
